Legislation with Medicare Reforms Passes Through U.S. House The U.S. House passed Medicare reforms this afternoon, which would make several improvements to the Medicare Part B program. Specifically, there are several provisions within the legislation that offer greatly needed reforms to HME and O&P. H.R. 3178, “Medicare Part B Improvement Act of 2017.” Home Infusion Therapy One provision of the bill would create a temporary payment system for in-home infusion drug services. This provision was originally introduced by Reps. Pat Tiberi (R-Ohio) and Bill Pascrell (D-N.J.) as H.R. 3163 as the Medicare Part B Home Infusion Therapy Services Temporary Payment Act. This temporary program would begin Jan. 1, 2019, and would create a transitional payment for 2019 and 2020 under Medicare Part B for home infusion drugs. This legislation is an effort to close the lapse in coverage for home infusion services that, as part of the 21st Century Cures Act, is not scheduled to become effective until 2021. Home Treatment Demonstration The measure would extend the Medicare Intravenous Immune Globulin (IVIG) Demonstration project through Dec. 31, 2020. It is scheduled to expire on Sept. 30. IVIG therapies treat individuals with weakened immune systems or diseases such as lupus. Under the IVIG Demo, Medicare covers items and services to administer IVIG at home to patients with primary immunodeficiency diseases. It’s limited to 4,000 Medicare beneficiaries and its funding is capped at $45 million from one of the Medicare trust funds. Orthotics and Prosthetic Medical Necessity This provision would allow the documentation produced by an O&P practitioner to be considered part of a patient’s medical record for purposes of determining medical necessity. This will greatly protect access for Medicare beneficiaries who depend on these services. This legislation was originally introduced as H.R. 3171 by Reps. Mike Bishop (R-Mich.) and Mike Thompson (D-Calif.) and is included in this bill.

Late this afternoon two additional senators have agreed to support the DMEPOS rural reforms letter being sent to HHS and CMS. This brings the total to 48 senators, just shy of half of the United States Senate. The two new senators on the list are Sens. Todd Young (R-IN) and Al Franken (D-MN). That means both Indiana and Minnesota are two more states with complete participation!

We are extremely pleased to share that a letter being sent to the Department of Health and Human Services (HHS) along with the Centers for Medicare and Medicaid Services (CMS) gathered 46 signatures. There are few bipartisan legislative efforts on Capitol Hill when it comes to healthcare, but getting nearly half of the Senate to support a letter over a holiday recess is not an easy task. Of the 46 senators that supported the letter there were 28 republicans, 17 democrats and 1 independent. States that had complete participation included: Alabama, Colorado, Florida, Hawaii, Iowa, Kansas, Mississippi, North Carolina, North Dakota, Ohio, South Dakota, West Virginia and Wyoming. VGM will pass along any response or future correspondence from HHS/CMS regarding both congressional letters sent in the past weeks. Thank you to everyone that took the time to call or message your senators. It is because of that effort this letter is a great success with nearly half of the United States Senate supporting the letter. Also, a huge thank you to all of the state associations that continued to encourage members to reach out to their senators.
