This means that we advance all costs of investigating and pursuing the case and only recoup these costs when we win. We also defer the payment of the lawyer’s fee until we win. Thus, the payment of fees and costs is contingent upon a successful outcome and the client does not have to pay in the circumstance where there is no recovery. Contingent fee arrangements like this are widely believed to benefit the civil justice system because it is the lawyer who bears the financial risk of the case and insures against the filing of frivolous lawsuits.
