Please be aware, if you hold your clients information digitally you may soon be more responsible for their information. Data Breach Insurance is usually not covered for most policies for a business and is something you should consider. Santa Fe, NM – This evening, the House of Representatives unanimously passed House Bill 15, known as the Data Breach Notification Act. The legislation is sponsored by Rep. Bill Rehm (R-Bernalillo). House Bill 15 would require service providers to implement reasonable procedures to protect the personal identifying information (PII) of consumers within their custody. It would also require providers to notify consumers whose PII may have been compromised by a security breach. Notice must be given to the Attorney General's Office and major consumer reporting agencies about security breaches affecting more than one thousand individuals no later than 45 days after the breach was discovered. "New Mexico is one of three states that do not have a data breach notification law," said Rehm. "Our laws have not kept up with the pace of technology. This bill will remedy a gap in our existing consumer protections and put us on par with other states." House Bill 15 will now be sent to the Senate for consideration.

A good reminder to drive safely.
Last week my girlfriend Jennifer Holland was in an accident on the Pacific Coast Highway. A tow truck slammed into the back of her Audi, shoving her car COMPLETELY UNDER a truck, which then hit another car which veered into the other side of the road, demolishing that car as well. I was coming out of a dinner when I got a phone call that Jen was being airlifted to the Ronald Reagan UCLA Medical Center. AIRLIFTED is not a word you want to hear in relation to anyone you care about. I of course rushed over. When I got there she was strapped down to a board with a neck brace, but, thankfully, alive. The doctors, nurses, and entire staff of the Medical Center were all efficient, gracious, and compassionate. They rushed her through CT scans, making sure there was no serious damage. And, although she was (and still is) in a hell of a lot of pain, she was able to come home with me before morning. I've posted the helicopter photo below of the truck on top of Jenn's car. If you were able to look at it from the side you'd be amazed that every single part of the car was crushed except for the small compartment Jenn was sitting in. We are extraordinarily fortunate. While at the hospital I was able to meet some of the other folks who were in the car crash, some of whom were hurt worse than Jenn, but all of whom are alive. I take two things from all of this. Firstly, all life is tenuous. We are soft, pulpy masses of flesh who experience our days by the grace of whatever-power-you-believe-in. I am grateful for each day I exist in this world, and, just as much, for the lives of those humans and creatures around me whom I love. And, today, I am mostly grateful for Jenn. A few inches difference in the trajectory of any of those cars and she wouldn't be here right now. Secondly, DRIVE CAREFULLY. There's a lot of panic these days about terrorist attacks - but an American is 407,000 times more likely to die from a car accident than he or she is from a terrorist attack. Almost all of us have been in a car accident and a lot of us know someone who has died in one. It is not a distant, theoretical threat, but a present one. If some small percentage of what's spent on combatting terrorism was spent on road safety we'd likely be saving exponentially more lives. So hug the ones you love. Enjoy each moment. It appears that moderate coffee drinking is associated with a reduced risk of an early death. However, there is not enough evidence that one should drink more coffee for the sake of longer life expectancy.
