Sumner County Social Media Policy & Consumer Terms of Use

The Sumner County Board of Education on behalf of Sumner County Schools (“SCS”) interacts with the community through digital platforms, including social media. SCS uses social media platforms such as Facebook, Twitter, Instagram, and others, to communicate with community members and to facilitate community engagement. Any form of digital communication through such platforms is classified as “social media.”

In order to ensure a friendly and safe digital environment for the exchange of ideas on SCS’s official social media sites, SCS has adopted the following terms of use. When accessing an official SCS social media site, you are agreeing to be bound by all terms, all applicable regulations and laws, and any other terms and guidelines established by SCS and those of any third parties that host our sites (such as Facebook). If you are unable to agree to these terms, do not use or access SCS’s official social media sites.

Content Moderation Guidelines
All official SCS social media sites constitute limited public forums, not public forums. The purpose of this limited public forum is to provide information about and encourage community engagement in the activities of SCS. SCS respects the rights of community members to express their views on forum topics. The SCS encourages all users to use the SCS social media sites for the stated purposes and to communicate with respect for others.

All comments made on SCS social media sites are reviewed by SCS social media team members. When posting on SCS social media sites, you are agreeing to comply with all of SCS’s Content Moderation Guidelines with regard to all information and comments that you post or share on the site. When using SCS’s social media sites, you agree your activity on our sites will not violate any applicable law or regulation, and that any unauthorized use of our sites is strictly prohibited.

By using an official SCS social media site, you represent that you are (1) at least 13 years old, or (2) if younger than 13 years old, you are using the social media site with the knowledge and consent of your parent or legal guardian.
All information and content posted on SCS’s official social media sites is owned by SCS unless stated otherwise. SCS reserves the rights to: (a) remove, add, or change any content, (b) delete or block any content that you post; and (c) monitor, suspend, or terminate your access to Sumner’s official social media sites. By using SCS’s official social media sites, you agree that in the event SCS exercises any of its rights as described above, SCS will have no liability to you. SCS does not represent that the information on its social media sites is accurate or reliable, and, therefore, all content must be read and used at your own risk.

A post, comment, or contribution may be edited or removed from SCS’s official social media sites for any of the non-exclusive reasons provided below:
Content that is defamatory, libelous, or slanderous; is harassing; constitutes a threat; is legally obscene or vulgar; or constitutes a violation of criminal law;
Content that infringes on intellectual property rights (such as copyright, trademark, patent, trade secrets, moral rights, rights of publicity, etc.);
Content that discriminates or targets a specific group on the basis of gender, race, religion, age, disability, national origin, gender identity, sexual orientation, or creed;
Content that includes confidential or proprietary information;
Content that includes URLs to other websites or links that may pose a risk of malware;
Content that constitutes spam or phishing attempts;
Content that is used for commercial purposes, advertising, or solicitation; and
Content that is not relevant to the purpose of SCS’s social media site and is likely to cause disruption to the purposes of the limited forum and its orderly and civil operation, including, without limitation, personal attacks.

The above list is not exclusive. Members of SCS’s social media team may remove content that is deemed inappropriate after review. The above rules apply to all forms of digital communication on the site, including comments, messages, and replies.

Official Communications & Viewpoint
Communication with SCS through social media sites does not constitute legal or official notice or communication with SCS. Official communications with SCS must be directed towards appropriate staff members either by telephone, mail, email, or in person in accordance with SCS policies and any relevant laws.

Members of Sumner’s social media policy will review the content on all social media sites, but the content may not be reviewed in real-time. Comments made on SCS social media sites represent the views of the author, and not necessarily the policies or opinions of SCS. SCS is not responsible for any of the content posted by users, including the content posted by agents or employees who are not authorized SCS social media site administrators.

Privacy & Security
By using SCS’s social media sites, you expressly acknowledge the risks inherent in sending content over a social media site, and you acknowledge that you are responsible for any and all liabilities or losses relating to security, confidentiality, and privacy. You further acknowledge that any and all posts may be considered to be public records subject to disclosure under Tenn. Code Ann. § 10-7-503. SCS further follows the applicable privacy policies of the third-party hosts of its social media sites, to the extent permitted by law.

Disputes and Jurisdiction
These terms of use shall be governed by the laws of the State of Tennessee. All legal proceedings related to or arising out of SCS’s terms of use shall be conducted in the courts situated within Sumner County, Tennessee, which each party agrees shall have exclusive jurisdiction and venue.

Liability Limitations
By accessing SCS’s social media sites, you agree that in no event or circumstance shall SCS be liable for any damages that arise out of your use of SCS’s social media sites.


Social Media Site Termination or Modification
SCS reserves the right to modify or change the functionality of its social media sites at any time, and without prior notice. Modification or termination of a SCS social media site does not affect, modify, or terminate any other existing agreements you may have with SCS.

Social Media Site Terms of Use Modifications
SCS may revise these terms of use for its social media sites without prior notice. By using the SCS social media sites you are agreeing to the terms of use as currently drafted. Any changes or modifications to the above terms shall be effective as of the date posted, and any use of the social media sites after such modifications are posted shall be deemed your consent to the modified terms of use.
