The IRS requires tax professionals to list their name, address, and PTIN on the 1040 form. If you pay someone to prepare your return and they list "Self-Prepared" as the preparer, DO NOT let them prepare or file your tax return. Those individuals are not licensed preparers. Today I reviewed a tax return prepared by a "Self-Prepared" paid preparer. The taxpayer will now be paying the IRS thousands of dollars. The taxpayer has tried to reach the preparer, but the preparer is in hiding. The taxpayer has reached out to other client's of the preparer, ALL of whom have been audited and are paying the IRS.

Financial institutions and brokerage firms are refusing to accept the authority of living trusts created for individuals to ease the burden placed on the successor trustee. Over the past year I've been working with several brokerage firms concerning the account what was in a living trust. The firms have requested copies of the death certificate and the trust documents. No news there. But after receipt of those documents the firms went on to request recertification of the trust. After that, then the firms are still not willing to accept the authority of the successor trustee. So they require forms created by their firm to be signed by an original trustee instead of the successor trustee. This can present a problem when the original trustee can no longer sign documents due to mental issues or due to death. Living trusts were touted as being the way to avoid delays in the distribution of assets to beneficiaries, and to avoid the most dreaded probate. However because of the way the financial institutions are now handling the trust accounts, successor trustees might not be able to liquidate the accounts. There are many valid reasons to create living trusts, ease and fast distributions are not two of those reasons.

New scam out there. Individuals posing as IRS Efile agents, calling to confirm the information listed on your tax return. Do not fall for this, IRS would never call and ask for your information.

Just a heads up for family and friends. Tax professionals are becoming more aware of the effect the Affordable Care Act will have on 2014 Tax Returns. The documents that taxpayers will need to obtain from employers, insurance agencies, or from the government health care providers could delay the return preparation. Once taxpayers have the needed documentation, the returns will be more complex than before. More time will be needed to complete the tax returns, which in turn, will cause the cost of tax preparation to increase. Last but certainly not least, we are hearing that Federal refunds will be delayed as the IRS tries to verify information on the tax returns with information they received from ACA providers.
