A product can be unreasonably dangerous by the manner in which it is manufactured, designed or marketed. The balance test to determine if a product is unreasonably dangerous is the possibility and severity of injury on one scale and the cost or effort necessary to avoid the dangerous condition on the other.

This area of law involves appeals from trial court decisions to state and federal appellate courts. Transcripts of the action before the trial court are obtained and appellate briefs are prepared. The briefs include fact summaries, citation and explanation of applicable laws and precedent, and argument on the position being taken in the appeal. Oral argument may also occur before the Court of Appeals or before the Supreme Court.
