1. What is bankruptcy?
Bankruptcy is an action that puts your estate under the control of a court appointed trustee who then determines what assets you have that can be liquidated and used to pay your debt.

2. What are the different types of bankruptcy?
CHAPTER 7 Liquidation

3. How long does it take?
In most cases, Chapter 7 payment plans are completed in five months. Chapter 12 and 13 payment plans last from three to five years.

4. Can bankruptcy stop a foreclosure?
Yes. Reorganization bankruptcy allows debtors to pay off the arrearage over time and continue to make payments on the mortgage.

5. Will I have to go to court?
One hearing is required in all cases, known as "meeting the creditors".

6. What happens to my property if I must file bankruptcy?
Certain property can be claimed as exempt. This is property you may keep. Any non-exempt property may be taken by the trustee and sold to pay of your creditors.

7. Can my creditors still contact me?
No, once the bankruptcy is filed, an automatic stay prohibits all collectors from collection activities.

8. Will I still have to pay my back taxes?
