• Sexual Harassment – This can involve anything from an employee suffering verbal abuse in the form of unwanted comments and gestures of a sexual nature to requests for sexual favors to crude jokes being told in the workplace that workers find offensive.
• Discrimination – Suffering unfair treatment at the hands of your employer, including but not limited to:
o Age Discrimination – Employees or potential employees over the age of 40 who have been fired, denied employment, improperly compensated, denied a promotion or improperly had their benefits reduced because of their age.
o Racial Discrimination – Employees or prospective employees who are treated unfavorably in the workplace because of their race or national origin.
o Gender or Sex Discrimination – Employees receiving less pay for doing equal work, being denied comparable benefits packages for doing the same job or who are denied promotions or fired because of their gender. This also includes applicants who are not hired because of their gender.
o Disability Discrimination – This applies when employers do things such as fail to make reasonable accommodations for, fail to promote, verbally harass or wrongfully terminate mentally or physically disabled workers.
o Pregnancy Discrimination – Employees not receiving reasonable accommodations, being fired or being treated unfairly after their employer discovers that they are pregnant.
o Sexual Orientation Discrimination – In Texas, employees who work for the federal government are protected against discrimination in the workplace due to their sexual orientation or gender identity. Unfortunately, private sector employees in Texas are currently not protected under state law against such treatment. However, that may not prevent private sector employees who have been the victim of sexual orientation discrimination at work from filing other claims related to their mistreatment under employment and labor laws, including gender discrimination, hostile work environment, workplace retaliation, sexual harassment and wrongful termination.
